If your state requires the EGR set up to be on the car, and I believe that NY does, you will need to keep that on your engine. If your state does not require the EGR system to be hooked up then you can remove the tubes and plug the ports on the back of the cylinder heads.
You do need to switch the stock headers on your engine to point forward in the Mk4 kit. Make sure you can still attach the EGR tubes to the headers if they are switched around to point forward.
